Dear Mr. Ewing:
In your letter of April 19, 1979, you requested the State
Ethics Commission to furnish you with an opinion pursuant to Section 7(9)
of Act 170 of 1978 as to the application of Section 3(e) of the Act
relative to your new position as Associate Director of The Associated
Petroleum Industries of Pennsylvania. In your letter you explained
that from December 1, 1976 to May 1, 1979, you served as a member of
the Senate Minority Leader's staff in the position of Director of
Intergovernmental Relations. You explained that your duties included
(1) maintaining effective communications and cooperation between the
Senate Minority Caucus and local, state and federal governmental
bodies; (2) maintaining communications with various business, labor,
trade and professional organizations; (3) scheduling meetings for
representatives of local government and various non - governmental
organizations with members of the Senate Minority Caucus; and (4)
assisting Republican Senators or staff with individual or local
government constituent problems. Your letter indicated that as of
May 1, 1979 you will be employed as an Associate Director of The
Associated Petroleum Industries of Pennsylvania, a division of the
American Petroleum Industries.
It is the Commission's opinion that as Director of Inter-
governmental Relations for the Senate Minority Leader you were a
"public employee" as that term is used in Act 170. Section 3(e) of
the Act prohibits a former employee from representing any person,
braodly defined in the Act to include corporations, associations,
"or other organizations or groups of persons ", on "any matter before
the governmental body with which he has been associated for one year
after he leaves that body." It is the Commission's opinion that the
term "governmental body" as defined in the Act includes the Senate

Minority Leader's Office and that as a former employee in that office,
you are prohibited by Section 3(e) of the Act from representing any
person on any matter before the Senate Minority Leader's Office for
a period of one year commencing on the date you resigned your position
as Director of Intergovernmental Relations.
This letter is a public record by law and will be made
available as such.
