Dear Senator Romanelli:

In your letter of February 2, 1979, you requested advice from
the State Ethics Commission concering the possible application of Sec-
tion 3(c) of Act 170 of 1978 to the rental of your legislative district
office. In your letter you explained that the legislative office is
located on the first floor of a building owned jointly by you and your
wife and that you pay rent in the amount of $150 a month. The rent
is disbursed by the Chief Clerk of the Senate from the Senate Home
Office account. Your letter indicates that you have not entered into
a written lease to rend the property for a specified period of time.
It is the opinion of the Commission that you have not entered
into a "contract...with a governmental body" as that term is defined in
the Act and therefore the rental of your legislative district office
under the circumstances as described in your letter does not conflict
with Section 3(c) of the Act.
This letter is a public record by law and will be made
available as such.
