BOX 1179 HARRISBURG, PA 17108 TELEPHONE: (717) 783 -1610 July 17, 1981 ADVICE OF COUNSEL RE: Former State Employee, Candidate for Office Dear Mr. Warfield: This responds to your letter of May 26, 1981 in which you requested advice of the State Ethics Commission. Issue: You inquire as to whether a former State employee may run for political office. Facts: You informed us that you are a former employee of the Commonwealth, Department of Community Affairs, where you served as Director of Human Services until February 25, 1981. You are running for the office of Mayor of York, Pennsylvania. Discussion: There is no violation of the Ethics Act, 65 P.S. §401 et seq., when a former State employee runs for elective office. You must, of course, comply with the disclosure and reporting of financial interests provisions of the Act, 65 P.S. §404, 405. Conclusion: The Ethics Act contains no prohibition which would preclude you from running for the office of Mayor of York. Pursuant to Section 7(9)(ii), this Advice is a complete defense in any enforcement proceeding initiated by the Commission, and evidence of good faith conduct in any other civil or criminal proceeding, providing the requestor has disclosed truthfully all the material facts and committed the acts complained of in reliance on the Advice given.
