ADVICE OF THE COMMISSION

Dear Mr. Hite:
On July 1, 1980 you asked the Commission to advise you on
your responsibilities under Act 170 as a former employee of
the Department of Community Affairs. You stated that you had
served as Executive Assistant to the Secretary prior to Novem-
ber 1979 and in that capacity recommended and implemented offi-
cial policy. You also stated that from November 1979 to June
1980 you continued employment with the Department but served
as a legislative analyst in the Departments office of legislative
relations and were responsible for analyzing pending legislation
but did not take or recommend official action. We have confirmed
this information with the Department of Community Affairs.
You are advised that you cannot represent anyone before the
,Department of Community Affairs for one year after leaving your
position as Executive Assistant. This bar does not prohibit
you from information and services available to the general public.
Pursuant to Section 7(9)(ii), this Advice is a complete
defense in any enforcement proceeding initiated by the Commission,
and evidence of good faith conduct in any other civil or criminal
proceeding, providing the requestor has disclosed truthfully all
the material facts and committed the acts complained of in reliance
on the Advice given.
