ADVICE OF THE COMMISSION
80 -703
On July 3, 1980, you asked for an opinion on whether
' your former position with the Department of Community Affairs
is covered by Act 170 and whether your participation in certain
specified activities would be prohibited.
The activities you specified were potential negotia-
tion of contracts with the following type of agencies:
1. The Department of Community Affairs
-as a course developer /trainer for the Training
Division of the Bureau of Local Government
Services.
2. Other State agencies
- specifically the Pennsylvania Historic and
Museum Commission and the Pennsylvania Housing
Finance Agency
3. Redevelopment authorities and municipalities
-on projects which received DCA housing or
redevelopment grants while you were Chief of
the Development Division
-on new projects which may or may not involve
application to DCA for housing or redevelopment
grant assistance
-doing general planning and community development
consulting
As an administrator of State Grant Programs you
were a public employee as that term is used under Act 170.
Your governmental body was the Bureau of Housing and Develop-
ment in the Department of Community Affairs.

Section 3 of Act 170 prohibits any former official
or employee from representing anyone before the governmental
body with which he or she has been associated for one year
after he or she leaves that body. You are prohibited from
representing anyone before the Bureau of Housing and Develop
ment for one year after you leave that organization.
There will be no conflict in your negotiating a
contract to be a developer /trainer for the training division
of the Bureau of Local Governmental Services. You could
also represent anyone and negotiate contracts with govern-
mental bodies other than the Bureau of Housing and Develop-
ment including those you noted above.
You would be restricted only from entering info
a contract in which your payment would be received from grants
in which you had an official role while with the Department
of Community Affairs.
Pursuant to Section 7(9)(ii), this Advice is a
complete defense in any enforcement proceeding initiated
by the Commission, and evidence of good faith conduct in
any other civil or criminal proceeding, providing the re-
questor has disclosed truthfully all the material facts and
committed the acts complained of in reliance on the Advice
given.
