Johnson Board of Probation and Parole Box 1661 Harrisburg, PA 17120 Dear Mr. Johnson: STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 August 20, 1980 ADVICE OF THE COMMISSION 80 -702 On June 6, 1980, you asked whether there would be a conflict if a field representative of the Board of Probation and Parole accepted a part -time position with the Commission on Accreditation for Corrections. He administers Grant -in -Aid programs and makes field visits to various county probation departments for the administration of these programs as a field repre- sentative of the Board. He is a "public employee" under Act 170. You noted that the position with the Commission would be done on his own time, he would never be assigned to consult for the Commission within the Commonwealth of Pennsylvania, but that some of the counties which he visits for the Board may seek accreditation through the Commission on Accreditation for Corrections. There would be no conflict of interest under Act 170 if the above conditions are met and the field repre- sentative obstains from participating in any decision on the accreditation request of counties in which he has official responsibility. Johnson August 20, 1980 Page 2 Pursuant to Section 7(9)(ii), this Advice is a complete defense in any enforcement proceeding initiated by the Commission, and evidence of good faith conduct in any other civil or criminal proceeding, providing the requestor has disclosed truthfully all the material facts and committed the acts complained of in reliance on the Advice given.
