On June 19, 1980, you asked for a review of a
Commission administrative letter on the duty to file
a Financial Interest Statement.
On November 7, 1979, the Commission issued opinions
No. 79 -065 (filing requirements of public officials and
public employees who leave office prior to January 1, 1980)
and 79 -066 (uniform treatment of public employees and
public officials in which they determined that all officials
and employees including those who were officials or employees
only during 1979 are required to file annually. Copies
of these opinions are attached and you are advised that they
apply to the situation you described in your request.
Pursuant to Section 7(9)(ii), this advice is a complete
defense in any enforcement proceeding initiated by the Commission,
and evidence of good faith conduct in any other civil or criminal
proceeding, providing the requestor has disclosed truthfully all
the material facts and committed the acts complained of in reliance
on the Advice given.
You may appeal this advice to the full Commission.
This letter is a public record and will be made available
as such.
