Second Street Harrisburg, PA 17102 Dear Mr. Junkin: STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 August 12, 1980 ADVICE OF THE COMMISSION 80 -699 On April 17, 1980, you asked for an opinion on whether your firm or individuals of your firm must file Financial Interest Statements in accordance with Section 5 of Act 170. On March 12, 1980, the Commission issued opinion 80- 014 on the status of an engineering firm. That opinion determined that engineering firms employed on a "per job" basis either because of unique experience or the award of a project contract were not required to file a Financial Interest Statement under Section 5 of Act 170. That opinion also decided that a firm employed on an "as needed" basis such as the township engineer, was covered by Act 170 and required to file a Financial Interest Statement. This requirement exists regardless of the method of payment. You or a principal of your firm would be required to file a Financial Interest Statement only with those govern- mental bodies where you provide consultation as needed, not in cases where you are employed for a particular project. A copy of your Financial Interest Statement should be filed with each of the former governmental bodies. Edward R.
