Broad St. Philadelphia, PA 19110 Dear Mr. Ostrander: STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 August 5, 1980 ADVICE OF THE COMMISSION 80 -696 On July 8, 1980, you asked us how a public official should report on his Financial Interest Statement money received from a Legal Defense Fund. You noted contributions to the fund would be delivered directly to the director of the fund who would hold such amounts in trust for the public official and that the names of the contributors and the amounts of their individual contributions would not be disclosed to the public official. Money received from this fund by the public official should be reported as a gift. The report should include the name of the fund, its purpose, the name of the director, and the amount received during the reporting period. Pursuant to Section 7(9)(ii), this advice is a complete defense in any enforcement proceeding initiated by the Commission, and evidence of good faith conduct in any other civil or criminal proceeding, providing the requestor has disclosed truthfully all the material facts and committed the acts complained of in reliance on the Advice given.
