On July 17, 1980, you asked whether there would
be a conflict if you engaged in consulting activities with
Honeywell Information Systems, Inc. You have been asked
to author a sales manual on the marketing requirements of
the public education sector.
The computer center of the University, which has
a Honeywell computer, reports to you in your official capacity
at the University. However, you were not a signatory to
the contract. You also noted that no privileged information
would be contained in such a manual nor would you become
a representative of Honeywell in any dealings as a result
of this manual.
There would be no conflict of interest under Act
170 if you author the sales manual as long as you do not
use your public office or any confidential information
gained through holding that office in the development of
the manual or its sales. In addition, you cannot become
a representative of Honeywell in any dealings before Indiana
University of Pennsylvania.
Pursuant to Section 7(9)(ii), this advice is a
complete defense in any enforcement proceeding initiated
by the Commission, and evidence of good faith conduct in
any other civil or criminal proceeding, providing the requestor
has disclosed truthfully all the material facts and committed
the acts complained of in reliance on the Advice given.
