ADVICE OF THE COMMISSION 80 -688
On March 6, 1980, you asked which officials and employees
in your office would be required to file Financial Interest
Statements.
On May 11, 1979, the Commission issued opinion 79 -007
in which they determined that assistant district attorneys
are public officials and required to file a Statement of
Financial Interest by Section 4 of Act 170. This opinion
would apply to your First Assistant District Attorney,
Deputy District Attorney, and all other attorneys in your
office.
Section 2 of the Act defines public employees for the
purposes of Act 170 as those persons who recommend or take
official action in specified functional areas or have a
greater than a de minimus economic impact on any person.
The Executive Assistant to the District Attorney and the
Director of Investigations would meet the criteria for
public employee and are required to file Financial Interest
Statements. The other employees listed in your letter are
not considered public employees under Act 170 and are not
required to file Financial Interest Statments.

Pursuant to Section 7(9)(ii), this advice is a complete
defense in any enforcement proceeding initiated by the Commission,
and evidence of good faith conduct in any other civil or criminal
proceeding, providing the requestor has disclosed truthfully all
the material facts and committed the acts complained of in reliance
on the Advice given.
You may appeal this advice to the full Commission.
This letter is a public record and will be made available
as such.
