On May 11, 1979, the Commission issued opinion 79 -007 in which they determined that assistant district attorneys are public officials and required to file a Statement of Financial Interest by Section 4 of Act 170. This opinion would apply to your First Assistant District Attorney, Deputy District Attorney, and all other attorneys in your office. Section 2 of the Act defines public employees for the purposes of Act 170 as those persons who recommend or take official action in specified functional areas or have a greater than a de minimus economic impact on any person. The Executive Assistant to the District Attorney and the Director of Investigations would meet the criteria for public employee and are required to file Financial Interest Statements. The other employees listed in your letter are not considered public employees under Act 170 and are not required to file Financial Interest Statments.
