Advice #80 -684
You asked whether representation of your fiancee in
Landlord - Tenant court would be a violation of the conflict
of interest provisions in Act 170. You noted that you were
an attorney in the Department of Labor and Industry.
Act 170 would prohibit you from representing any person
before your governmental body or before that governmental
body for one year after you leave your position. Your
governmental body is the Department of Labor and Industry.
There would be no conflict of interest under Act 170
in your representing your fiancee in Landlord- Tenant court.
Pursuant to Section 7(9)(ii), this advice is a complete
defense in any enforcement proceeding initiated by the Commission,
and evidence of good faith conduct in any other civil or criminal
proceeding, providing the requestor has disclosed truthfully all
the material facts and committed the acts complained of in reliance
on the advice given.
