Box 1265 Harrisburg, PA 17108 STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 June 23, 1980 ADVICE OF THE COMMISSION Advice #80 -683 Dear Mr. Hetrick: On June 17, 1980, you asked whether your being a registered lobbyist while serving as County Commissioner would present any conflict of interest under Act 170. As an elected county official you are a public official as that phrase is used in Act 170. Your governmental body would be the Office of the County Commissioners and all organizations under the jurisdiction of that office. You would be prohibited from representing anyone before the Dauphin County Commissioners or any organizations under their jurisdiction. However, Act 170 would not bar your representation of any person or organization before the Pennsylvania General Assembly as long as you do not use your office of County Commissioner or confidential information gained through that office for the representation. Pursuant to Section 7(9)(ii), this advice is a complete defense in any enforcement proceeding initiated by the Commission, and evidence of good faith conduct in any other civil or criminal proceeding, providing the requestor has disclosed truthfully all the material facts and committed the acts complained of in reliance on the Advice given.
