ADVICE OF THE COMMISSION
On June 11, 1980, you asked whether you would have a
conflict under Act 170 if you were a candidate for the
position of Chairman of the Republican Committee for the
Elizabethtown Area School District while serving as a
research assistant to Senator Richard A. Snyder. You
noted that your duties for Senator Snyder include
research into legislative hearings, workshops and other
areas involving research requirements.

As a research assistant you would not be a "public
employee" as that term is used in Act 170.
There would be no conflict of interest in your being
a candidate for office while working as a research assistant
in the office of Senator Snyder.
Pursuant to Section 7(9)(ii), this advice is a complete
defense in any enforcement proceeding initiated by the Commission,
and evidence of good faith conduct in any other civil or criminal
proceeding, providing the requestor has disclosed truthfully all
the material facts and committed the acts complained of in reliance
on the Advice given.
You may appeal this advice to the full Commission.
This letter is a public record and will be made available
as such.
