Saltzer, Acting Deputy Secretary for Adminstration of the Department of Health forwarded your letter requesting an opinion. You asked whether there was a conflict of interest in your serving as a public health nurse at the Lansford State Health Center of the Department of Health and also as the Health Officer for the Borough of Tamaqua. Advice #80 -680 By telephone on June 20, 1980, you told me that Tamaqua was not part of your official territory as a public health nurse. You also informed me that there would be no adverse relationships between your activities as a health officer in Tamaqua and the Department of Health. There would be no conflict of interest under Act 170 in your serving in both positions. Pursuant to Section 7(9)(ii), this advice is a complete defense in any enforcement proceeding initiated by the Commission, and evidence of good faith conduct in any other civil or criminal proceeding, providing the requestor has disclosed truthfully all the material facts and committed the acts complained of in reliance on the Advice given. You may appeal this advice to the full Commission. This letter is a public record and will be made available as such.
