'MITH Chairm Advice #80 -678 On March 12, 1980, you asked whether a citizen appointed on a zoning hearing board, a non - compensated position, who is also a member of the Board of the 'Municipal Authority of Washington Township would have a conflict of interest under Act 170. By phone on June 20, 1980, you informed me that there was no relationship between these governmental bodies and you could see no circumstance under which one would review the action of the other. There is no inherent conflict in one person serving on the zoning hearing and municipal boards. If some unique circumstance should cause one board to review the action of the other, the person on both boards should abstain from the review. Pursuant to Section 7(9)(ii), this advice is a complete defense in any enforcement proceeding initiated by the Commission, and evidence of good faith conduct in any other civil or criminal proceeding, providing the requestor has disclosed truthfully all the material facts and committed the acts complained of in reliance on the Advice given. This letter is a public record and will be made available as such.
