Box 80 180 Moyer Drive Dublin, PA 18917 Dear Mr. Dalton: STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 June 10, 1980 ADVICE OF THE COMMISSION Advice #80 -673 On April 30, 1980, you asked whether you, as a Supervisor of Special Education Classes, were required to file a Financial Interest Statement under Act 170. On June 9, 1980, you gave me the following information by telephone: 1. Your participation in purchasing is one of processing orders for items which teachers require. 2. General supplies are ordered from a master contract which has been already awarded by the school board. 3. Other purchase requests must be approved by the assistant executive director, the executive director, the business manager, and the school board. The process may not follow the exact order noted here. 4. You cannot make purchases without following the process noted in item 3. 5. You do not normally engage in the other activities cited in the public employee definition of Act 170. Because you do not have the authority to take final action nor to recommend final action at the level defined in our regulations, you are not a public employee as that term is used in Act 170 and not required to file a Financial Interest Statement. Dalton June 10, 1980 Page 2 Pursuant to Section 7(9)(ii), this advice is a complete defense in any enforcement proceeding initiated by the Commission, and evidence of good faith conduct in any other civil or criminal proceeding, providing the requestor has disclosed truthfully all the material facts and committed the acts complained of in reliance on the advice given. You may appeal this advice to the full Commission. This letter is a public record and will be made available as such. PJS /rdp
