Box 348 Media, Pennsylvania 19063 Dear Mr. Gallagher: STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 June 3, 1980 ADVICE OF COMMISSION Advice #80 -671 On April 21, 1980, you asked whether assistant deputy controllers who are involved in auditing practices and in reviewing various bills and contracts with the county would be required to file a Financial Interest Statement under Act 170. Public employees are defined in Act 170 include persons who are engaged in auditing. Our regulations further define the definition of public employee and include those engaged in the auditing functions you described. Assistant deputy controllers are public employees under Act 170 and required to file a Financial Interest Statement. Pursuant to Section 7(9)(ii), this advice is a complete defense in any enforcement proceeding initiated by the Commission, and evidence of good faith conduct in any other civil or criminal proceeding, providing the requestor has disclosed truthfully all the material facts and committed the acts complained of in reliance on the advice given.
