Advice #80 -670
On June 3, 1980 you asked whether Mr. Stanley'0. Thomas, Chairman
of the State Board of Barber Examiners and the head teacher of the Tri -City
Barber School of Philadelphia has a conflict of interest under Act 170.
You wrote that the barber school in which he teaches is the site for the
barber examination in Philadelphia and the school is paid a sum of approxi-
mately $600 for holding the examination. You also wrote that the Barber
Examination Board does not vote on the schools to be used as test sites
and the contract has been renewed as a matter of administrative procedure.
You noted that Mr. Thomas is a salaried employee of the school and does
not have a financial interest in the school.
As Chairman of the State Board of Barber Examiners, Mr. Thomas is a
public official as that term is used in Act 170. There is no inherent
conflict in this situation. However, to avoid the appearance of conflict
Mr. Thomas should abstain from any action including the examination site
contract involving the Tri City Barber School of Philadelphia.
Pursuant to Section 7 (9) (ii), this advice is a complete defense in
any enforcement proceeding initiated by the Commission, and evidence of
good faith conduct in any other civil or criminal proceeding, providing
the reqeuestor has disclosed truthfully all the material facts and com-
mitted the acts complained. of in reliance on the advice given.
You may appeal this advice to the full Commission.
