Advice #80 -669
On March 11, 1980 you asked whether the appointment of Deci
Corporation as your acting engineer would present a conflict of
interest. You wrote that the president of the Deci Corporation is
the Chairman of your municipal authority.
There is no inherent conflict in this appointment. However, to
avoid the appearance of conflict all business conducted with the Deci
• Corporation by the township - other than the work they would do as your
acting engineer -, and the municipal authority should be done through an
open and public process as required by Section 3(c) of Act 170.
Pursuant to Section 7 (9) (ii), this advice is a complete defense
in any enforcement proceeding initiated by the Commission, and evidence
of good faith conduct in any other civil or criminal proceeding, providing
the requestor has disclosed truthfully all the material facts and coimdtted
the acts complained of in reliance on the advice given.
You may appeal this advice to the full Commission.
