On March 12, 1980, you asked whether your office, which
represented a township during 1979, would be required to list
those individual business or associates who paid the township
for legal work which was done by your firm on behalf of the
',township. The township paid your firm as the solicitor and
the firm did not receive payment from the individuals.
Commonwealth Court has enjoined the Ethics Commission
from requiring the filing of Financial Interest Statements
from second -class township solicitors, borough solicitors and
others. By administrative action the Commission has decided
that no solicitor will be required to file a Financial
Interest Statement until the Court decisions have been made.
Should the Ethics Commission prevail in these Court
actions, you would not be required to list the names of those
individuals in the circumstances described in you March 12, 1980
letter.
Pursuant to Section 7(9)(ii), this advice is a complete
defense in any enforcement proceeding initiated by the Commission,
and evidence of good faith conduct in any other civil or criminal
proceeding, providing the requestor has disclosed truthfully all
the material facts and committed the acts complained of in reliance
on the advice given.
You may appeal this advice to the full Commission.
This letter is a public record and will be made available
as such.
