Seaford 15 Walnut Street Carlisle, PA 17103 Dear Mr. Seaford: STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 June 2, 1980 ADVICE OF COMMISSION Advice #80 -658 On January 3, 1980, you asked what restrictions would be placed upon you if you left employment with the Bureau of State Lotteries, Department of Revnue and went to the private sector. You were employed as an Information Specialist II in the Bureau. You had functioned as Acting Director of the Public Relations section from April 1979 to the date of your letter. You stated you were responsible for in -house development of training and promotional aids, general public relations such as media coordination, public inquiries and project development. There were no functional duties as described in the definition of public employee in Act 170. Therefore, he would not be a public employee as that term is used in Act 170 and would not be restricted by the Act. However, if you engaged in recommending or taking official action in the functions noted in the definition of public employee, you would be prohibited from representing your private firm before the Bureau of State Lotteries for a period of one year after you left that organization. You would be allowed to manage a contract awarded by that Bureau and gather information normally available to the general public. Pursuant to Section 7(9)(ii), this advice is a complete defense in any enforcement proceeding initiated by the Commission, and evidence of good faith conduct in any other civil or criminal proceeding, providing the requestor has disclosed truthfully all the material facts and committed the acts complained of in reliance on the advice given.
