ADVICE OF COMMISSION
Advice #80 -655
Dear Mr. McCoy:
On March 4, 1980, you asked whether incumbent school
board directors must file a Statement of Financial Interest on
',or before May 1, 1980 and whether sucessful candidates for the
office during 1979 must file.
We are currently enjoined by the Pennsylvania Supreme Court
from requiring school board members to file a Financial Interest
Statement. We interpret this injunction as prohibiting us from
requiring candidates or incumbents to file a Financial Interest
Statement. Oral arguments in this case where heard by the
Pennsylvania Supreme Court on May 22, 1980.
We Will contact interested parties once we receive a
Court decision.
Pursuant to Section 7(9)(ii), this advice is a complete
defense in any enforcement proceeding initiated by the Commission,
and evidence of good faith conduct in any other civil or criminal
proceeding, providing the requestor has disclosed truthfully all
the material facts and committed the acts complained of in reliance
on the advice given.
You may appeal this advice to the full Commission.
This letter is a public record and will be available as such.
