Grode Executive Director Commission on Crime & Delinquency STATE ETHICS COMMISSION 308 FINANCE BUILDING HARRISBURG, PENNSYLVANIA 17120 May 29, 1980 ADVICE OF THE COMMISSION Advice #80 -653 On May 6, 1980, you asked whether members of the Juvenile Advisory Committee of the Commission on Crime and Delinquency were required to file Financial Interest Statements. You noted that this group is advisory in nature and has no authority to expend public funds. You also asked which office was responsible for reviewing and maintaining the Financial Interest Statement forms of the members of the Supervisory Board of the Commission. Section 2 of Act 170 states that the term public official shall not include members of advisory boards that have no authority to expend public funds. Therefore, the members of the Juvenile Advisory Committee are not required to file Financial Interest Statements. The Commission regulations published on April 19, 1980 delegate the responsibility for designating the location for the filing of Financial Interest Statements to the governmental body. In this case, the Commission on Crime and Delinquency should designate the office which will review and file these forms. Pursuant to Section 7(9)(ii), this advice is a complete defense in any enforcement proceeding initiated by the Commission, and evidence of good faith conduct in any other civil or criminal proceeding, providing the requestor has disclosed truthfully all the material facts and committed the acts complained of in reliance on the advice given.
