Advice #80 -652
On April 28, 1980, you asked whether you would have a
conflict if you accepted a part -time consultant position with the
Pennsylvania State University on a research project. You
,noted you are now employed as a Legislative Assistant to
Senator Stout.
Act 170 prohibits a "public employee" from using their
office or information from that office for personal financial
gain. The information you provided indicates that these
circumstances would not exist in your roles as a Legislative
Assistant and part -time Consultant to the Pennsylvanis State
University.
You would not be in conflict of Act 170 by holding both
positions.
Pursuant to Section 7(9)(ii), this advice is a complete
defense in any enforcement proceeding initiated by the Commission,
and evidence of good faith conduct in any other civil or criminal
proceeding, providing the requestor has disclosed truthfully all
the material facts and committed the acts complained of in reliance
on the advice given.
You may appeal this advice to the full Commission.
This letter is a public record and will be made available
as such.
