Miller Commissioner Professional & Occupational Affairs Dear Mr. Miller: Advice #80 -650 On May 19, 1980, you asked whether Mr. Jack Thompson, a member of the State Board of Cosmetology and recently elected to a Vice - President position in the Pennsylvania Association of Cosmetology Schools had a conflict under Act 170. The Commission has issued a number of opinions (Lutton, 79 -024; Vavro, 79 -074; Alfano, 80 -007) holding that a member of a State examining board cannot be an officer in an association representing the regulatees. Mr. Thompson's holding of both positions is a conflict of interest under Act 170 and he must resign from one of the positions. Pursuant to Section 7(9)(ii), this advice is a complete defense in any enforcement proceeding initiated by the Commission, and evidence of good faith conduct in any other civil or criminal proceeding, providing the requestor has disclosed truthfully all the material facts and committed the acts complained of in reliance on the advice given. You may appeal this advice to the full Commission. This letter is a public record and will be made available as such. PJS /rdp
