ADVICE OF THE COMMISSION
Advice #80 -647
On May 1, 1980, you asked whether you, as a township
supervisor, have a conflict of interest as an officer and
shareholder in Maloney Auto Body, Inc. which the township
has designated as an official impounding station.
You also noted that you were not a township official
when this action was taken and that you would obstain from
voting on the issue should it arise while you are a supervisor.
You are an elected public official under Act 170. Section 3(c)
of the Act allows an elected public official to have a contract with
his or her governmental body if it is done through an open
and public process.
There is no conflict under Act 170 in Maloney Auto Body, Inc.
being designated as an official impounding station. You must
abstain from participation in township discussions or decisions
if this matter comes to their attention while you are in office.
Pursuant to Section 7(9)(ii), this advice is a complete
defense in any enforcement proceeding initiated by the Commission,
and evidence of good faith conduct in any other civil or criminal
proceeding, providing the requestor has disclosed truthfully all
the material facts and committed the acts complained of in reliance
on the advice given.
You may appeal this advice to the full Commission.
This letter is a public record and will be made available
as such.
