Advice #80 - 641
On December 13, 1979, you asked whether you, as a borough
councilperson, could be hired as an assistant borough manager.
You stated that if you would accept the job, you would resign
your councilman position.
As a borough councilman you are a public official as
that term is used in Act 170. Section 3(a) of the Act prohibits
any public official from personal financial gain through the
use of his or her office or information there in. There would
be no conflict of interest in your being appointed as assistant
borough manager if you abstained from all discussions and the
decision in this action.
Pursuant to Section 7(9)(ii), this advice is a complete
defense in any enforcement proceeding initiated by the Commission,
and evidence of good faith conduct in any other civil or criminal
proceeding, providing the requestor has disclosed truthfully all
the material facts and committed the acts complained of in reliance
on the advice given.
You may appeal this advice to the full Commission.
This letter is a public record and will be made available
as such.
