RE: Appointment of Antoni T. Klar to State Board of
Cosmetology
FACTS:
#80 -638
On April 24, 1980 you asked whether Antoni T. Klar's
appointment to the State Board of Cosmetology created any
conflict of interest.
Ms. Klar is District Manager, supervising 23 salons
in Central Pennsylvania and is on the Advisory Board of the
Empire Beauty Schools International Center for Hair Design.
She has been appointed to the State Board of Cosmetology.
The Board regulates persons involved in beauty culture.
Section 459 of the Administrative Code provides that
"five members of the board shall be at least 25 years of age
and shall have had at least five years practical experience
in the majority of the practices of cosmetology. It also
provides for two persons representing the public at large.
There is no inherent conflict in Ms. Klar's service on
the State Board of Cosmetology. However, she must abstain
from taking part in any matter involving any of her business
interests before the Board.
Pursuant to Section 7(9)(ii), this advice is a
complete defense in any enforcement proceeding initiated
by the Commission, and evidence of good faith conduct in
any other civil or criminal proceeding, providing the
requestor has disclosed truthfully all the material facts
and committed the acts complained of in reliance on the
advice given.
