ADVICE OF THE COMMISSION
Advice #80 -637
On May 9, 1980 you asked whether you could maintain
your stock interest and purchase additional stock in the
Engineering and Associative Design Services Firm while
you serve as a Councilman in the City of Altoona.
On January 22, 1980 we responded to a previous
request stating that you could continue your employment
with the firm. However, any contract awarded to EADS must
follow an open and public process in accordance with Act 170.
You are further advised that you may continue your stock-
holdings and purchase additional stock.
Pursuant to Section 7(9)(ii), this advice is a
complete defense in any enforcement proceeding initiated
by the Commission, and evidence of good faith conduct in
any other civil or criminal proceeding, providing the
requestor has disclosed truthfully all the material facts
and committed the acts complained of in reliance on the
advice given.
You may appeal this advice to the full Commission.
This letter is a public record and will be made
available as such.
