On April 9, 1980, you asked whether the appointment
of the daughter of a chairperson of the board of trustees
at a state college to a position at that college would be
a conflict of interest.
On March 12, 1980, in the Routch Opinion (80 -019), the
Commission ruled that "An authority can employ a member of
the authority or a member of his or her immediate family
providing there is prior public notice of the position a-
vailable, its terms, and the subsequent public disclosure
of the identity of the individual receiving the position."
This opinion would apply to your request, and you are ad-
vised that a conflict will be avoided if the above process
is followed.
Pursuant to Section 7(9) (ii), this advice is a
complete defense in any enforcement proceeding initiated
by the Commission, and evidence of good faith conduct in
any other civil or criminal proceeding, providing the
requestor has disclosed truthfully all the material facts
and committed the acts complained of in reliance on the advice
given.
