ADVICE OF COMMISSION
Uncompensated authority members are not subject to the
disclosure requirements of the State Ethics Act.
There is presently an injunction outstanding in the
case of Forney, et al v. State Ethics Commission, issued
April 30, 1980, enjoining the Commission from requiring any
authority members and "public employees" of authorities to
file a Statement of Financial Interest.
Should the Commission prevail in Commonwealth Court,
uncompensated authority members will still be exempt from the
disclosure requirements, but "public employees" of authorities
would be required to file Statements of Financial Interests with
their authority. In the case of your redevelopment authority, the
solicitor would appear to be the only "public employee." The
coverage of solicitors as "public employees" is under review by
Commonwealth Court in a number of cases and we have been enjoined
from requiring the filing of Financial Interest Statements by them.
