On April 10, 1980 you asked how Act 170 would apply
to the following circumstances.
1. Whether you may sell any item to the Borough of
Myerstown up to a value of $500. without competi-
tive bidding. You are correct. Section 3 (c) of
Act 170 prohibits public officials or public employees
or a member of their family from entering into a con-
tract valued at $500. or more with their governmental
body unless the contract has been awarded through an
open and public process including prior public notice
and subsequent public disclosure of all proposals con-
sidered and contracts awarded.
2. Your selling material to other political sub - divisions
without competitive bidding up to $2500.00, etc. -
Act 170 does not prohibit you from selling materials
to any political sub - division other than your own as
noted above.
3. The coverage of voluntary emergency service organi-
zations by Act 170. Normally these organizations
would not appear to be covered but I cannot respond
for any individual agency without information on how
they are chartered, their sources of funding, etc.
