ADVICE OF CHIEF COUNSEL
On November 30, 1979 you asked for an opinion or advice
of the State Ethics Commission. This request could not be
answered until regulations were developed. The Commission
approved the final publication on April 7, 1980 and you are
advised as follows:
1. An assistant district superintendent will be
required to file a Financial Interests Statement
with his or her school district by May 1 of each
year beginning with May 1, 1980.
2. School building principals will also be required
to file Financial Interest Statements in the same
manner and time as superintendents.

3. School district business managers also must meet
the same filing requirements; school board secretaries
are not considered public employees under the Act and
do not file a Financial Interest Statement.
4. Public officials who are appointed and not compensated
are not covered by Act 170 for the purposes of filing
a Financial Interest Statement. I believe this would
apply to the school building authority members.
5. The assistant school district business manager and head
of maintenance may have to file Financial Interest
Statements depending upon the amount of delegation to
them. If they recurringly make recommendations to the
person who has the authority to make the final decision
in those areas specified in the public employee definition
of Act 170, they would be required to file a Financial
Interest Statement.

6. School directors filing requirements will be
specified after the Supreme Court has made a
decision. The Commission will abide by that
decision and administer the Act within its
guidelines.
You will be receiving a copy of the Commission's final
regulations in approximately one week.
