On November 8, 1979 you asked for an opinion or advice
of the State Ethics Commission. This request could not be
answered until regulations were developed. The Commission
approved the final publication on April 7, 1980 and you are
advised as follows:
You do not have to file a Financial Interest Statement
unless you have these responsibilities.

ADVICE OF CHIEF COUNSEL
Chief hearing officers are generally not considered
to be employees under Act 170 and are not required
to file Financial Interest Statements. Exceptions
would be those individuals who have authority to
make final decisions or recommendations in areas
such as contracting, procurment, administering or
monitoring grants as cited in the definition of public
employee in the Act.
