On October 30, 1979 you asked for an opinion or advice
of the State Ethics Commission. This request could not be
answered until regulations were developed. The Commission
approved the final publication on April 7, 1980 and you are
advised as follows:
1. Elected township commissioners file a Statement
of Financial Interests only with their governmental
body in the years in which they are not candidates.
When they are candidates, they will file an original
with the State Ethics Commission and a copy with
their governmental body.
2. Township treasurers, unless they are elected as
public officials or are able to exercise discretion
and judgment in one of the areas cited in the public
employee definition of Act 170, are generally not
required to file a Financial Interest Statement.
3. Building inspectors, plumbing inspectors, sewage
enforcement officers are required to file a
Financial Interest Statement.
4. Road workers and police officers are not required to
file a Financial Interest Statement.
5. Members of the various boards who are appointed and
not compensated are not required to file Financial
Interest Statements. This would probably apply to
your planning commission, zoning hearing board, board
of appeals and civil service commission.
