BOX 1179 HARRISBURG, PA 17108 TELEPHONE: (717) 783 -1610 April 25, 1980 ADVICE OF CHIEF COUNSEL On April 25, 1980, Tracy Passerotti advised the Commission that he is the Vice President in the Erie County Association of Supervisors in addition to being a Harbor Creek Township Supervisor. He asked if he could do work for governmental bodies outside of Harbor Creek Township consistent with the State Ethics Act? The Commission has ruled in T. C. Williams, 79 -12, that there is no conflict of interest in a public official in one political subdivsion entering into any contracts with any other governmental bodies of other political subdivisions. Further, Mr. Passerotti's status as an officer in the County Association of Supervisors does not raise any question of a conflict of interest in his doing work with a political subdivision whose supervisors are part of that association, since the County Association of Supervisors has no control over any political subdivision. Pursuant to Section 7(9)(ii), this advice is a complete defense in any enforcement proceeding initiated by the Commission, and evidence of good faith conduct in any other civil or criminal proceeding, providing the requestor has disclosed truthfully all the material facts and committed the acts complained of in reliance on the advice given.
