BOX 1 179 HARRISBURG, PA 17108 TELEPHONE: (717) 783 -1610 April 16, 1980 ADVICE OF CHIEF COUNSEL Advice #80 - 611 On March 14, 1980 you asked for an opinion or advice of the State Ethics Commission. This request could not be answered until regulations were developed. The Commission approved their publication on April 7, 1980 and you are advised as follows: DRM /rdp 1. A newly appointed councilman who has filed subsequent to January 1, 1980 does not have to file another Financial Interest Statement for that year. 2. A compensated fire chief is covered by Act 170 if he makes inspections under the fire code. Uncompensated appointed public officials are not covered. 3. A borough inspector enforcing the health ordinances of the borough is covered by Act 170 and is required to file a Financial Interest Statement prior to May 1 of each year. 4. A public official or public employee engaged in business needs to report only those clients where the source of payment was from the governmental body in which he or she is a public official or public employee. Our final regulations should appear in the Pennsylvania Bulletin within the next two weeks and a copy will be sent to you directly from our office in about 10 days. David R.
