ADVICE OF CHIEF COUNSEL
Advice #80 -602
On September 19, 1979 you asked for an opinion or
advice of the State Ethics Commission. This request could
not be answered until regulations were developed. The
Commission approved their publication on April 7, 1980 and
you are advised as follows:
1. School board members coverage will be determined
by the Pennsylvania Supreme Court in a case now
pending.
2. All authority and board members who are appointed
and not compensated are not covered by the State
Ethics Act and are not required to file a Financial
Interest Statement.
3. All solicitors for boards, authorities and other
municipalities are covered by the State Ethics Act
and are required to file a Financial Interest Statement
with their governmental body. They do not file with
the State Ethics Commission.
4. Treasurers for various municipalities, boards, and
commissions are generally not covered by the State
Ethics Act and are not required to file a Financial
Interest Statement. If they are delegated authority
to make funding and contractual decisions as opposed
to implementing the specific instructions of the
governing authority, then they would be required to
file a Financial Interest Statement with their
governmental body.

On April 7, 1980 the Commission in approving final regulations
determined that only officials at the Commonwealth level would be
required to file Financial Interest Statements with the State Ethics
Commission. All other officials file only with their governing
authority except in the years when they are candidates. In those
years, they file the original with the State Ethics Commission
and a copy with their governmental body.
A copy of our final regulations will be sent to you in
approximatley 10 days.

5. Secretaries of boroughs, township, school boards, and
various authorities are not generally covered by the
State Ethics Act and are not required to file a Statement
of Financial Interest unless they have been delegated
authority beyond the usual responsibilities of those
jobs.
6. Superintendents, assistant superintendents, principals,
and business managers of school districts are covered
by the State Ethics Act and are required to file
Financial Interest Statemens with their governmental
body.
7. All elected an appointed borough and township
officials except secretaries and secretary- treasurers
are covered by the State Ethics Act and required to
file Financial Interest Statements.
