ADVICE OF CHIEF COUNSEL
Advice # 80 -597
On June 13, 1979 you asked for an opinion or advice
of the State Ethics Commission. This request could not be
answered until regulations were developed. The Commission
approved their publication on April 7, 1980 and you are
advised as follows:
Forms have been sent to all municipal secretaries. However,
I am enclosing 6 for your use.
Enclosures
DRM /rdp
1. Municipal and school board solicitors are required
to file Financial Interest Statements by May 1 of
each year. These statements are to be filed with
their governmental bodies.
2. Professionals and other attorneys shall disclose
those sources of income of $500 or more paid for
services related to matters before the governmental
body with which the public official, public employee
or candidate is or would be associated. I am enclosing
Sections 5.7 & 5.8 of our regulations which will give
you more details.
3. If a firm is appointed as solicitor, the governmental
body is to designate the person in the firm who shall
file a Financial Interest Statement. The form does
not have to include information for each shareholder,
director, and officer of the professional corporation.
4. Municipal code enforcement officers are subject to
the provisions of the Act and must file a Financial
Interest Statement.
Sincere
