Krizner Law Offices, McCandless & Krizner 213 South Main Street Butler, PA 16001 Advice # 555 RE: Disclosure of pension and social security income by a•spouse of a public official. FACTS: On July 31, 1979, Mr. Krizner asked whether pension and social security income of a spouse of a public official must be reported on the statement of financial interest. The issue is the definition of income for the purposes of Act 170. In regulations published in the Pennsylvania Bulletin of February 9, 1980, the Commission proposes that the source of income from any governmental welfare program, social security, railroad retirement, and pension be exempt from reporting. Neither a public official nor his or her spouse are required to report source of income from pension or social security payments. Pursuant to Section 7(9)(ii), this advice is a complete defense in any enforcement proceeding initiated by the Commission, and evidence of good faith conduct in any other civil or criminal proceeding, providing the requestor has disclosed truthfully all the material facts and committed the acts complained of in reliance on the ,advice given.
