RE: Financial interest statement filing requirement
of a borough manager.
On November 7, 1979, Mr. Plonski, Borough Manager of
Norristown, asked whether he was required to file a state-
ment of financial interest.
Section 2 of the Act defines a public employee as one
who recommends or takes official action of a non - ministerial
nature with regard to contracting or procurement; administering
or monitoring grants or subsidies; planning or zoning; etc.
Mr. Plonski, as Chief Administrative Officer of the
Borough, is directly responsible for certain areas of
purchasing, procurement, inspections, planning and zoning,
contracting and grants administration.
Mr. Plonski is a public employee as term is
defined in Act 170 and is required to file a statement
of financial interest by May 1st of the year following
each year he holds such a position.
Pursuant to Section 70 )(ii), this advice is a
complete defense in any enforcement proceeding initiated
by the Commission, and evidence of good faith conduct in
any other civil or criminal proceeding, providing the
requestor has disclosed truthfully all the material facts
and committed the acts complained of in reliance on the
advice given.
