Financial interest statement filing requirements of
a public official who resigns before the end of 1979.
On November 12, 1979, Mr. Van Tassel, a Councilman
for Blooming Valley Borough, stated that it was his
intention to resign before the end of 1979 and asked
whether he would have to file a financial interest
statement.
The issue is whether an official .who resigns in
1979 is covered by Act 170 and thus required to file
a statement of financial interest.
As an elected offical, Mr. Van Tassel is a public
official as that term is used in Act 170.
In Opinion No. 79 -065 (Carter), 'the Commission
determined that all individuals who are public officials
or public employees in 1979 are required to file a
financial interest statement for that year by May 1, 1980.
Mr. Van Tassel, as a public official in 1979, is
required to file a financial interest statement with
his governmental body by May 1, 1980 for the year 1979.
Pursuant to Section 7(9)(ii), this advice is a
complete defense in any enforcement proceeding initiated
by the Commission, and evidence of good faith conduct in
any other civil or criminal proceeding, providing the
requester. -bas disclosed truthfully all the material facts
and committed the acts complained of in reliance on the
.advice given.
