Box 104 Main Capitol Building Harrisburg, PA 17120 RE: Gifts received from grandparents Advice Number 79 - 543 On October 12, Representative Piccola'wrote to ask whether gifts received from grandparents are to be excluded from reporting requirements. Section 2 excludes from the definition "gift" a gift received "from a relative within the third degree of consanguinity of the person or of the person's spouse." Section 5(b)(6) excludes gifts received from grandchildren. Since grandparents are within the third degree of consanguinity, gifts from grandparents are excluded from the reporting requirements of Act 170. Pursuant to Section 7(9)(ii), this advice is a complete defense in any enforcement proceeding initiated by the Commission, and evidence of good faith conduct in any other civil or criminal proceeding, providing the requestor has disclosed truthfully all the material facts and committed the acts complained of in reliance on the advice given. A personal appearance before the Commission and a formal opinion will be issued upon your request, if you feel this reply does not suffice.
