RE: Act 170 requirements of.candidates and incumbents of
the office of school directors.
FACTS:
On February 14, you asked the Commision for an opinion
on the filing requirements of incumbents and candidates for
the office of school director.
The Ethics Commission delayed response pending resolution
of litigation before Commonwealth Court questioning the Act's
coverage of school directors.
Commonwealth Court issued a decision on August 31st
dismissing the suit and finding that school directors are
covered.
The Ethics Commission - at a public meeting on
September 5, 1979 established October 8, 1979, as the final
filing date for candidates for school director.
Section 4(d) states "no public official shall be allowed
to take the oath of office nor enter or continue upon his
duties, nor shall he receive compensation for public funds,
unless he has filed a statement of financial interests with
the Commission as required by this Act."
CONCLUSION:
Act 1 of 1979 made Section 4(d) effective January 1, 1980.
Candidates for school director offices in the election
of the fall of 1979 must file a Financial Inter.e &t Statement
with the Ethics Commission by October 8, 1979.
Incumbents will be required to file a Financial Interest
Statement no later than May 1, 1980.
