Dear Mr. Maier:
In your letter of July 10, 1979 you asked three questions:
1. Does a township zoning officer have to rile a statement
or finanical interest?
2. Does the township sewage officer have to file a
:statement of financial interest?
3. Do =bars ors of the township planning conmisnion who
receive no compensation have to comply with the Act?
nuention 1 t 2 will be decided between now and necemT:er of
1979 'through a Commission opinion or rules and regulations. We
will notify you when those decisions are ;jade. I£ township
zoning officers and sewage officers are determined to be public
employees, they will have until Play 1, 1930 to file a statement.
Ueribers of the planning commission who receive no cone' nsation
and are appointed are not covered by Act 170. I am enclosing
copies of prior Commission opinions on this question.
In accordance with Section 7(9)(ii), this advice "shall be
a complete defense in any inforcenent proceedings intitiate by
the Commission, and evidence with good faith conduct in any other
civil or criminal zal proceeding, if the requestor, at least 21
working days prior to the ledge violation requested written
advice from the Commission in good faith, and disclose truthfully
all the material facts and committed the acts complained of
either in reliance on the advice or because of the failure of the
Commission to provide advice within 21 days of the request of
such later extended time."
