Dear Mr. Palermo:
In your letter of December 27, 1978, you asked the
following questions of the Commission:
1. What is the effective date of Section 4?
Sections 4(a) and (d) apply to public employees
and public officials and are effective January 1,
1980. The latest filing date for persons covered
by these sections is May 1, 1980. Sections 4(b)
and (e) apply to candidates for public office and
are effective August 1, 1979. Persons covered by
these subsections must file a Financial Interest
Statement by September 7, 1979.
2. What is the reporting period for a Financial
Interest Statement filed by May 1, 1980? Calendar
year 1979 in accordance with Section 5(b) of Act
170.
3. Could forms to be filed by School Directors in the
Spring of 1979 he sent to you?
As noted previously, Act 1, of 1978 changed the
effective date to August 1, 1979. A class action
suit on behalf of School Directors was also filed.
A preliminary injunction prohibited requiring
School Directors to file. The case was heard on
June 15, in Commonwealth Court. The status require -
ments of School Directors will be determined by
that court ruling. When the court issues a decision,
I will give you additional information.
I am enclosing some copies of the Financial Interest
Statement and an informational pamphlet for your information.
