Martin Solicitor, larmar Township 3400 Grant Building Pittsburg, PA 15210 Enclosures August 10, 1979 Advice Number 79 -509 Dear Attorney Martin: In your letter of December 19, 1978, you asked what . the Act 170 coverage and responsibilities were for a township solicitor, township engineer, township planning consultant, township planning commissioners, township zoning hearing board members, and township zoning officers. The Commission has issued opinions relating to solici- tors (King, UcFate); appointed non - compensated commission and board members (Sidari, Collie, Tobin, Weitzman). I am attaching copies of those opinions for your information and use. In our telephone conversation of August 10th, you said the township engineer was hired with a retainer and paid addit- ional amounts whenever his services were issued; the planning consultant was paid on an hourly basis as needed and the zoning hearing officers were probably paid on a fee basis. No opinions or advice specifically related to these questions have been ren- dered by the Commission. These questions will be submitted to the Commission for review and a response will be made to you prior to January 1, 1980. This is the effective date of coverage for public employees and non - elected officials and I believe you will agree that advice before that date would be timely. I am also enclosing a digest of the opinions which the Commission has issued to date and an opinion on municipal author- ities created under Public Law 382.
