Dear Mr. Wagner:
This will serve to acknowledge your letter dated
April 4, 1979 to the Ethics Commission in which you describe
the possible conflict of interest existing with your law
firm and the South Middleton Planning Commission.
It is my opinion that you are free to continue your
representation of certain developers in this matter until
and unless the Ethics Commission formally rules to the con-
trary. Further, to be safe it would be wise to publically
acknowledge any possible conflict in this matter and to com-
ply rully with the Code of Ethics governing the legal profes-
sion in such matters.
Public disclosure of a possible conflict is tanta-
mount to compliance with the spirit of the Act. In the event .
that the Commission at its formal hearings reaches a different
conclusion, you will be so advised.

pursuance of your practice.
