ADVICES (Ethics):
16-560 (Edley): Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose restrictions upon employment of a
Special Advisor to the Secretary of Human Services
for the Commonwealth of Pennsylvania following
termination of employment with the Pennsylvania
Department of Human Services.
16-561 (White): Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose restrictions upon employment of a
Transportation Construction Inspector following
termination of employment with the Pennsylvania
Department of Transportation (“PennDOT”).
16-562 (Yee): Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose restrictions upon employment of a
Transportation Construction Manager 3 following
termination of employment with the Pennsylvania
Department of Transportation (“PennDOT”).
16-563 (Giangiordano): Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose prohibitions or restrictions upon an
individual, who resigned from his position as a
member and president of a charter school board of
trustees in order to serve as the acting chief executive
officer of the charter school for a period of less than
one month, with regard to: (1) being reappointed as a
member of the charter school board of trustees
following termination of his service as the acting chief
executive officer; or (2) receiving compensation for his
service as the acting chief executive officer.
16-564 (Metzger): Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose prohibitions or restrictions upon a
former Executive Director of the Pennsylvania Liquor
Control Board (“PLCB”) with regard to receiving

payment in the form of honoraria for giving lectures to
classes as a visiting professor at a university that
holds several licenses issued by the PLCB.
16-565 (Jones): Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose prohibitions or restrictions upon
Members of the Board of Supervisors of Potter
Township (“Township”), Beaver County,
Pennsylvania, with regard to receiving compensation
for time devoted to matters pertaining to an ethylene
cracker facility that is being constructed in the
Township by Shell Chemical Appalachia, where such
compensation would be in excess of the annual
maximum compensation payable to township
supervisors pursuant to Section 65606(a) of the
Second Class Township Code, 53 P.S. § 65606(a).
16-566 (Wido): Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose prohibitions or restrictions upon an
individual with regard to performing the duties of his
public position as a borough council member if he
would apply for or obtain employment as a part-time
laborer with the borough street maintenance
department.
16-567: Re: Whether the Public Official and Employee
Ethics Act (“Ethics Act”), 65 Pa.C.S. § 1101 et seq.,
would impose restrictions upon employment of an A
for Commonwealth Agency B following termination of
Commonwealth employment.

16-005 (Klemick): Re: Whether a Highway Design Supervisor with the
Pennsylvania Department of Transportation
(“PennDOT”) under job code 10330 would be
considered a “public employee” subject to the Public
Official and Employee Ethics Act (“Ethics Act”), 65
Pa.C.S. § 1101 et seq., and the Regulations of the
State Ethics Commission, 51 Pa. Code § 11.1 et seq.,

and would therefore be subject to the requirements
for filing Statements of Financial Interests.
16-006 (Lozano): Re: Whether a Highway Design Supervisor with the
Pennsylvania Department of Transportation
(“PennDOT”) under job code 10330 would be

DETERMINATION OF THE COMMISSION:
16-2004 (Hafner, II): Re: Whether service as Chairman of the
Pennsylvania Turnpike Commission and/or as
Executive Director/Chief Executive Officer of the
Convention Visitors Bureau of Greater Monroeville
would bring Mr. Sean Logan within the definitions of
the terms “executive-level public employee” and/or
“public official” as set forth in the Gaming Act at 4
Pa.C.S. §§ 1103, 1512(b).
